§ 1 Scope and Amendments

These Terms and Conditions apply to the use of the platform ibesucher.com, in particular the traffic exchange service (Surfbar) and related features. If the user purchases a VIP membership, additional conditions outlined in § 3a apply.

iBesucher reserves the right to modify these Terms at any time. Changes will be notified before the next login or use of the platform. If the user does not object within one month, the updated Terms shall be considered accepted.

§ 2 Registration and User Agreement

Using the platform requires registration. The contract is established upon submission of the online registration form. No confirmation is required by iBesucher. Multiple registrations are permitted, provided that self-referral to gain credit advantages is avoided.

§ 3 Free Services

After registration, the user gains access to the Surfbar. Usage of the Surfbar earns credits, which can be spent on displaying the user’s own websites within the network. Submitted websites must be reviewed and approved by iBesucher before display.

Members can refer new users and receive bonus credits when the referred users actively use the Surfbar.

§ 3a VIP Membership (Paid Services)

Members may purchase a paid VIP membership, which offers enhanced features and higher earnings. The specific advantages are listed on the website. VIP memberships can be revoked within 14 days if unused (per UK Consumer Law). Minors must have consent from their legal guardian.

§ 4 Member Obligations

• All registration details must be accurate and kept up to date.
• Login credentials must be kept confidential.
• Only compliant websites may be submitted (see § 5 ff.).
• The Surfbar may not be manipulated or loaded automatically through iframes or external frames.
• Spamming (e.g., via email or forums) is strictly prohibited.
• The user agrees to receive occasional system notifications by email.

§ 5 Permitted Websites

The following websites are prohibited:

• Websites with illegal, offensive, or harmful content (e.g., child pornography, racism, warez)
• Adult websites or erotic content as a primary focus (exception: see § 5b)
• Banner-only pages with no meaningful content
• Sites with disruptive scripts, popups, frame breakers, or excessive CPU usage (exception: see § 5a)

iBesucher reserves the right to reject websites without explanation.

§ 5a Websites with Popups

Websites may be accepted if they open only one additional popup window that complies with all other requirements. The website must be flagged as a popup site. Popups from banned services (e.g., those using dialers) are prohibited and may result in credit deductions.

§ 5b Websites with Erotic Banners

Websites with erotic banners may be accepted if:

• The banner is not the main content
• The content is FSK-18 compliant (legal for adults)
• The website is clearly marked as containing adult banners

§ 6 Violations

In case of violations of the content policies (§§ 5, 5a, 5b), iBesucher reserves the right to remove affected websites, suspend the user account, and deduct credits. Violations may be reported by other users and, if verified, may result in bonus credits for the reporter.

§ 7 Content and Liability

iBesucher is not liable for the content submitted by users or sponsors. Contracts with third parties (e.g., advertisers) are solely between the member and the third-party provider.

§ 8 Data Protection

The separate Privacy Policy applies. Personal data is processed only in accordance with applicable data protection laws. Data is not shared with third parties unless required by law or with explicit consent.

§ 9 Availability and Warranty

iBesucher does not guarantee uninterrupted availability of its services. Downtime due to maintenance or technical issues may occur. iBesucher is not liable for damages caused by minor negligence. If the service is discontinued, active VIP memberships will be refunded proportionally.

§ 10 Termination and Account Deletion

• The user agreement may be terminated at any time by either party without notice.
• Members must terminate via the account deletion form on the login page.
• Accounts inactive for over 90 days may be deleted automatically.
• Upon termination, the account and all data will be deleted. Unused credits will not be refunded or paid out.
• VIP memberships continue until the end of the paid period unless a serious breach occurs.

§ 11 Final Provisions

English law shall apply. If any provision of these Terms is invalid, the remaining provisions shall remain unaffected.
